We'll see what ends up happening on retrial, but I thought this was an interesting emerging area of law. What if the issue wasn't technical incompetence? How much "personal background" should a doctor have to tell a patient before treatment can begin? Medical school grades? Failure to pay income tax? Should doctors be required to disclose to patients the fact that they've been treated for mental illness themselves?
There are a number of different ways that improper delay in the provision of medical care could result in harm to a patient -- the delay may have made your condition worse, it may have negated the possibility that certain treatment could be administered, it could have blunted the effectiveness of a certain treatment method, or it could have unnecessarily prolonged or intensified your pain and discomfort.
Calitz explains that to bring a successful medical malpractice claim, you need to prove that the treatment you received deviated from a particular “standard of care”, and that it was the deviation (which can be an act or omission) from this standard that resulted in harm. The “standard of care” is defined as what a reasonably prudent medical provider would or would not have done under the same or similar circumstances.
It's also critical not to allow yourself to be intimidated by the medical system. Speak up and advocate for your own well-being. If patients sense that something is wrong, they should tell—or ask—their health-care providers. Although it's important to trust your doctor or nurse, it's also important to listen to your body ... and use common sense. Also advisable: Have a family member or friend accompany you on important visits to health-care providers.
Even though current compensation awards take longer lifespans into account, there could still be a mismatch between the assumed lifespan and the actual lifespan of the patient. An arbitration agreement that contracts medical providers to cover the cost of health care for the actual lifetime of the patient removes this risk, Kellerman says, and it would provide the greatest benefit. Waiting for five to eight years for a court resolution is avoided, and there is no erosion of compensation by contingency fees (up to 25 percent), as the costs of the mediation are usually prescribed by fixed tariffs. The process does not place an emotional or financial burden on the injured party, and resolution, if done proactively from the outset, could take less than two years.
A malpractice claim exists if a provider's negligence causes injury or damages to a patient. However, experiencing a bad outcome isn't always proof of medical negligence. Also, on occasion, health-care providers will inform a patient that the person has received negligent medical care from a previous health-care provider and—presumably in an effort at complete honesty—will sometimes tell a patient that they, themselves, have made a mistake.
Among the leading causes of medical misdiagnosis is a failure to communicate diagnostic test results. Communication of a diagnosis is arguably as important as the diagnosis itself. Patients deserve to know the results of the medical tests they receive in a timely manner. Test results should also be communicated from the lab or testing facility to the medical providers responsible for the patient’s treatment.
Asking a lay juror to determine negligence in a field as nuanced and complex as medicine proved to be problematic. This issue was alleviated by formalizing the requirement of expert witnesses to assist the lay juror. On the issue, the Wisconsin Law Review wrote "The complexity of any technical field, medicine included, may well disable a lay juror who seeks independently to assess the relative risks and benefits attending a given course of conduct. That, however, only means that the juror needs advice from experts (genuine experts)' who can identify the risks and benefits at issue. Thus informed, there is no reason that a juror cannot and should not pass on the appropriateness of anyone's conduct, including a physician's."
Most people are able to get to at least second base with a failure to warn claim. Fewer are able to prove that the doctor simply did not talk to them about that particular risk, although there are cases where a patient’s word has been accepted over a doctor’s insistence that a warning was given. Getting copies of the doctor’s medical notes can help with this element.
"The opinion upholding the judgment recognizes that although not every fiduciary relationship will give rise to a claim for damages, where the specific professional responsibility of an attending physician is to convey accurate information, then failure to do so can give rise to liability if the physician's breach results in unusual and extreme emotional distress on the part of the plaintiff," Raynes said in an email, according to AMN.

Even if one manages to get a court to take jurisdiction, enforcing a judgment may be nearly impossible. If the judgment is obtained in America, enforcing the judgment in a foreign nation may require filing an entirely new lawsuit to domesticate the judgment, which could take nearly as long as pursuing the case in that country in the first place. If the judgment is domestic, or if the nation agrees to domesticate the judgment of a US court, foreign laws regarding collection of judgments usually differ greatly from American laws and may interfere with seizing or levying on assets and accounts.
Still, in a few cases, it is possible to say that the doctor or other medical professional acted so poorly that their behavior was actually criminal. The most common instances are those in which doctors or other medical professionals issue prescriptions to patients in dosages that they know, or should know, could be dangerous. An example of such a prosecution was the doctor who prescribed pain medications to famed pop singer, Michael Jackson. Other examples of criminal misconduct by doctors include surgeons attempting procedures while impaired by drugs or alcohol, or so-called “pill mills” that prescribe medications in volumes that could only be used for illegal distribution.
Previously, a New York appeals court had also ruled that a couple was allowed to sue a fertility clinic for emotional distress after the clinic implanted the female plaintiff’s embryo in another woman, and although neither of the plaintiffs suffered physical injuries, the appeals court ruled that the couple had suffered substantial emotional injury due to the defendants’ breach of their duty of care.
Regardless of how much you want to be the one selected to do the procedure, that's the patient's choice not yours. I think it's smart to look into a physician's background before selecting them to do surgery. I would want to know how much experience you have or if there had been malpractice issues. Patients are the ones paying and taking the risks. They get to decide how much risk they're willing to take -not the physician. If you refuse to answer the questions, which I do believe is your right, then it lets the patient decide what to do next - either get on the medical board website and see if anything has been reported, talk to more people, find another physician who doesn't mind answering the questions, etc.

Medical malpractice cases almost always require medical experts to testify about the proper standard of care that should have been provided under the circumstances. These are often physicians who practice within the same type of medicine that the physician defendant practices in. These individuals are usually tasked with the responsibility of explaining that the defendant deviated from the standard of care and that this deviation resulted in the patient suffering the harm alleged in the complaint.
Most (73%) settled malpractice claims involve medical error. A 2006 study concluded that claims without evidence of error "are not uncommon, but most [72%] are denied compensation. The vast majority of expenditures [54%] go toward litigation over errors and payment of them. The overhead costs of malpractice litigation are exorbitant." Physicians examined the records of 1452 closed malpractice claims. Ninety-seven percent were associated with injury; of them, 73% got compensation. Three percent of the claims were not associated with injuries; of them, 16% got compensation. 63% were associated with errors; of them, 73% got compensation (average $521,560). Thirty-seven percent were not associated with errors; of them, 28% got compensation (average $313,205). Claims not associated with errors accounted for 13 to 16% percent of the total costs. For every dollar spent on compensation, 54 cents went to administrative expenses (including lawyers, experts, and courts). Claims involving errors accounted for 78 percent of administrative costs.
The medical industry uniquely benefits from broad autonomy and self-regulation. Standardization of care and general oversight work to balance physician autonomy, and some may say they even erode that autonomy to an extent. Health Maintenance Organizations (HMOs) enforce patterns of practice to which providers must adhere. Emerging technologies throughout the 20th century paved the way for new treatment methods, but they also “raised patient expectations [while] multiplying the possibilities for mishaps.” In an examination of the interplay of autonomy and oversight, the Drexel Law Review wrote "Standardization and oversight serve to further reinforce patient expectations. By way of contrast, a disorganized profession typified by idiosyncratic practices discourages perceptions of consistent quality. Formal organization of the medical profession was intended, in part, to counter this characterization.”
A misdiagnosis or delayed diagnosis itself is not evidence of negligence. Skillful doctors can and do make diagnostic errors even when using reasonable care. The key is determining whether the doctor acted competently, which involves an evaluation of what the doctor did and did not do in arriving at a diagnosis. This means looking at the "differential diagnosis" method the doctor used in making treatment determinations.

Is our situation unique? According to the MPS report, in the United States there have been two waves of legal reforms prompted by medical malpractice claims: one in the mid-80s and another in the early 2000s. Reforms were driven by an increase in insurance premiums and concerns about access to health care. That deadline is set by a law known called a “statute of limitations.” Every state has passed these kinds of laws, with different deadlines according to the kind of case you want to file. In almost every state, there is a dedicated statute of limitations that applies to medical malpractice cases.

In most cases, a hospital is liable in the legal sense only if an employee’s negligence or incompetence results in injury to a patient. A medical malpractice lawsuit may be the proper course of action if a nurse, an aide, a technician, or any other hospital employee injures a patient by negligently performing or failing to perform a job-related task.
While both doctors in the above example should be able to diagnose the flu or pneumonia with relative ease, it would be more difficult to argue that the rural doctor was negligent for missing a diagnosis of some type of exotic disease usually only seen in people from foreign countries. On the other hand, the big city infectious disease expert would likely be negligent in not making the same diagnosis.
The next step is to prove that the defendant doctor breached the standard of care. What should the doctor have done, and what was actually done? For example, if the standard of care required the doctor to refer the patient to a specialist before terminating the doctor-patient relationship, failure to do so would constitute a breach of the standard of care. The expert's opinion comes into play at this stage as well, painting a picture of how the care provided was sub-standard under the circumstances.
A 2011 study in the New England Journal of Medicine reported that 75% of physicians in "low-risk" specialties and virtually 100% of physicians in "high-risk" specialties could expect to face a malpractice claim during their careers. However, the authors also noted that the vast majority of malpractice claims did not lead to any indemnity payments.

Prior to his presidency, Abraham Lincoln was a distinguished medical malpractice attorney, taking on cases for physicians and patients alike. The patient survived and was left with a crooked right leg when the splints were removed. The trial resulted in a hung jury.
Once the complaint has been filed, pre-trial preparation begins with the discovery period. The discovery of facts is often accomplished in 2 different ways: interrogatories and depositions. Interrogatories are questionnaires that witnesses fill out and are typically used for gathering preliminary details. Depositions are face-to-face interviews in which witnesses are sworn in and transcripts of the interviews are transcribed, but they do afford the attorneys the opportunity to ask follow-up questions and gather more in-depth information.
