This Health Policy Report describes the malpractice system in the United States, examines its shortcomings, and analyzes the forces that have led to past and current malpractice crises. The authors review options for reform of the U.S. malpractice system. Conventional tort reforms include caps on damages, limits on attorneys' fees, and shortening of the statute of limitations. Experts have also proposed major system reforms, such as enterprise liability or administrative compensation.
They can easily get away with anything while hiding behind "confidentiality/patient privacy." They can also be knuckleheads because there is no agreement , consensus or strict definition of the various conditions. They can make any statement sounds nuts. I agree with taping (but the client keeps the tapes) and if the shrink objects, find someone else.
I'm on my 4th Psychiatrist in the same practice over the past several years. I've been diagnosed with severe anxiety, manic depression, Bipolar and even ADHD. I also see a therapist in the same office who actually happens to be a Dr., 2 of the Psychiatrists were not actual MD's. they were associates. The therapist is the reason I keep going back though, he is helpful and doesn't always agree with the medications I've been prescribed. They even had me go through 6 1/2 weeks of TMS treatment, 45 minutes a day 5 days a week.
What if a patient feels mistreated after the completion of therapy? Example: patient seeks contact with therapist after some new issues surfaced and being told he can't contact therapist because it would create a vortex in space-time which would subsequently swallow the entire universe (or something...) Threatening a person recovering from anxiety with law suit for trying to contact therapist seems heavy handed in the case when patient is just trying to find a solution and understand what's happening.
Liability insurance eventually took its seat as a crucial player in medical malpractice suits. The Massachusetts Medical Insurance Society, founded in 1908, was among the first to provide and make mention of insurance against “unjust suits for alleged malpractice” in 1919. On one hand, the nascent brand of insurance offered physicians peace of mind; settlements and damages would be covered. On the other hand, it served to assure plaintiffs that every meritorious claim should be brought forward, as that claim would almost certainly see payment.

It is not easy to get a full picture of the increase in medical malpractice cases in South Africa, as there is no central register. Cases can be settled in court, out of court or via mediation. If matters are settled out of court or via mediation, there is no public record of compensation. However, if all sources of information are collated, it would certainly appear that both the number and levels of claims are increasing, and this is affecting the overall cost of health care in the country, including what you pay for medical scheme cover.

According to the act, when the patient arrives at the ER or urgent care center, the hospital must determine whether the patient’s condition constitutes an emergency. If it does, the hospital must make all reasonable efforts to stabilize the patient. If a hospital fails to comply with the act, the patient may sue the hospital for both the monetary equivalent of the harm caused by the failure, and for an additional penalty of up to $50,000.
Medical malpractice involves an injury brought about by a breach in the duty of care that a doctor or another medical professional owes their patient. A glaring example might be if the doctor sewed you up with a medical tool left inside of your body, but a less obvious one might be misdiagnosing you and treating a disease that you do not have while neglecting to treat the one they failed to diagnose.
Doctor Mistake, Serious Injury – Despite significant harm to the patient, sometimes it is impossible to prove a case of medical malpractice against a physician.  For example, an older patient with a heart condition may die after receiving the wrong medication.  After an investigation, experts may determine that although the physician prescribed the wrong medication, the incorrectly prescribed drug had the intended effect on the patient.  In this case, there is physician negligence (for prescribing the incorrect medication), but no causation (the mistake did not cause the harm to the patient).

Medical malpractice suits are complex, and you will need the help of a specialized personal injury attorney. If you have reason to believe that you have been a victim of malpractice, and would like to investigate the possibility of bringing your ex-doctor to justice, get in touch with Herrman & Herrman’s experienced personal injury attorneys to discuss your case. We have brought unprofessional medical personnel to account for their carelessness in surgery, prescription of medication, incorrect or failed diagnosis, birth injuries and more.
However, our legal system is set up in such a way where monetary damages is not only a way to compensate persons for lost wages, medical bills, and pain and suffering; it is also there as a way to hold doctors accountable for their actions. Without the threat of monetary sanctions and lawsuits, doctors would lose some motivation for conducting their professional lives in a careful and cautious manner. Furthermore, if you doctor did negligently injure you or a loved one, bringing suit against him may serve as a wakeup call and could possibly prevent him from injuring someone else in the future.
When you consider the time it takes for your attorney to conduct an initial investigation, gather the facts and early evidence, track down a medical expert, conduct required settlement negotiations and/or go through the medical screening panel or other pre-suit requirements, you can begin to see why most medical malpractice plaintiffs are in a scramble to beat the limitations deadline from the moment they decide to sue. (To find your state's time limit to file a medical malpractice case, see this chart.)
