The "medical standard of care" is a legal concept that refers to the type and amount of care that a similarly-skilled and trained doctor would have provided under the circumstances. Incidentally, even when I was one week out of school if a patient asked when I graduated I told them the truth. Early on I did see an occasional look of fear at learning I was a newbie, but none of them asked for someone else. However, if they had asked for someone else that would have been their right and I would have respected their wishes. It's their money, their body, and their decision.
This is often the most difficult part of medical negligence cases and even lawyers have trouble getting their heads around it sometimes.  You may be able to prove that a doctor did the wrong thing, but you also have to prove that what happened next was the result of that wrong thing and you have to prove that it would not have happened if the wrong thing had not been done.  Deciding whether or not this is the case involves both factual and legal issues and is sometimes very hard to do.  You really need a lawyer who is highly experienced in medical negligence cases to look at this for you.

Furthermore, we all inform our patients to some degree about the risks and benefits of procedures, meds, etc. Never have I heard that one's own track record or disciplinary history should be included. And in this case we don't for what the doc was disciplined or what led to the death. It may or may not have been relevant to Willis. The real issue here is whether he failed to warn her of the possibility of the perforation. The only thing going for the plaintiff here is that she likely claims that she would have chosen a different surgeon had she known the truth. Easy to say in retrospect when plaintiff and attorneys stand to gain $$. And apparently the same complication could as easily have occurred with a different surgeon anyway.

Most doctors and other medical professionals carry malpractice insurance to protect themselves in case of negligence/unintentional injury to their patients. The insurance may even be a requirement for employment within a specific medical group or hospital system. Some states, but not all, have minimum insurance requirements for medical providers. Malpractice insurance will cover both attorney costs and any money given to the plaintiff as the result of a settlement or verdict until it is exhausted, and then the medical provider or facility may be responsible for any excess verdict or judgment against them.

I'm on my 4th Psychiatrist in the same practice over the past several years. I've been diagnosed with severe anxiety, manic depression, Bipolar and even ADHD. I also see a therapist in the same office who actually happens to be a Dr., 2 of the Psychiatrists were not actual MD's. they were associates. They even had me go through 6 1/2 weeks of TMS treatment, 45 minutes a day 5 days a week.

The Supreme Court of the United Kingdom decided in 2018 that the duty of care extended to information given to patients by clerical staff. A patient at Croydon Health Services NHS Trust's emergency department suffered severe brain damage having been given misleading information by staff at reception. He was told that he would be seen by a doctor in four or five hours and left the hospital, when actually he would be seen inside 30 minutes by a triage nurse.[8]
Im going through this right now, a dr. Did a 45 min eval on me at the request of dfs just to make sure i was "ok" an this woman said i was borderline psychotic and narcissistic. . she made up lies on the report to support her claim.. And i cant get a 2nd opinion because dfs only excepts reports from workers in their department... I dont know what to do. These people are the devil.
There is a statute of limitations (or time limit in which you can file a lawsuit) for medical malpractice cases. This limit varies from state to state, but in general it is about two years from when the injury occurred. To ensure you file a claim before the statute of limitations is up, you should reach out to a medical malpractice attorney as soon after you realize doctor error occurred.
The situation is different for patients injured in an emergency room. Usually, the hospital does not have an opportunity to inform emergency room patients that a doctor is not an employee. If the doctor performs procedure B after the patient has given informed consent for procedure A, the patient can sue the doctor based on lack of informed consent. This is true even if the procedure was successful. For example, if a doctor operates on the left leg to remove a growth that is on the right leg, the patient may be able to sue for, among other things, lack of informed consent.

Unlike the traditional medical culture in which physicians and other professionals are discouraged from acknowledging their mistakes or discussing what happened with the injured patient/their family, ADR models promote straightforward communication and peaceful resolution.
